2. Service Description
MAILER PICK provides an email extraction and validation platform. Our service allows users to extract email addresses from text, files, and websites, and validate them using DNS/MX records. We offer both free (guest) and paid (Pro) tiers of service.
3. Acceptable Use Policy
You agree NOT to use our service for:
- Extracting emails for spam, phishing, or unsolicited marketing
- Violating anti-spam laws (CAN-SPAM, GDPR, CASL, etc.)
- Harvesting emails from websites without permission
- Attempting to access internal networks via SSRF
- Uploading malicious files or content
- Exceeding rate limits or circumventing usage restrictions
- Reselling or redistributing extracted email lists
- Any illegal or unauthorized purpose
4. User Responsibilities
As a user, you are responsible for:
- Ensuring compliance with all applicable laws and regulations
- Obtaining proper consent before using extracted emails for marketing
- Providing accurate information when creating an account
- Keeping your account credentials secure
- All activities that occur under your account
- Monitoring your usage to stay within plan limits
5. Intellectual Property
The MAILER PICK platform, including its original content, features, and functionality, is owned by us and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
6. Payment Terms (Pro Plan)
- Subscriptions are billed monthly in advance
- All payments are processed securely via Stripe
- Prices are subject to change with 30 days notice
- You may cancel at any time; access continues until the billing period ends
- Refunds are available within 7 days of purchase
7. Refund Policy
We offer a 7-day money-back guarantee for Pro subscriptions. If you're not satisfied with our service, contact our support team within 7 days of your initial purchase for a full refund. Refunds are not available for partial months or after the refund period has expired.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
We do not guarantee:
- 100% accuracy of email extraction or validation
- Uninterrupted or error-free service
- That extracted emails are valid or deliverable
- Specific results from using extracted emails
We are not responsible for any damages arising from your use of extracted emails, including but not limited to bounced emails, spam complaints, or blocked domains.
9. Limitation of Liability
To the maximum extent permitted by law, MAILER PICK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, regardless of the cause of action. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless MAILER PICK and its affiliates from any claims, damages, losses, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.
11. Termination
We reserve the right to terminate or suspend your access to the service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service will immediately cease. Provisions that should survive termination will continue to apply.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MAILER PICK operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page. Your continued use of the service after such modifications constitutes acceptance of the updated Terms.
